Marquita Burch, accused of killing a toddler and lying to authorities that led to a two-state search, was indicted Monday for murder after the coroner ruled 13-month-old William Cunningham may have lived with quick treatment.

?This child did not have to die,? Hamilton County Prosecutor Joe Deters noted in a Monday press release announcing the indictment.

?It is bad enough that Burch injured the child, but horrible to think of the child?s suffering ? it?s clear the child might have survived if (Burch) had sought prompt medical treatment.?

Burch, 26, was charged with murder, child endangering, manslaughter, tampering with evidence and gross abuse of a corpse in connection with the May 23 death of the toddler. The charges carry a maximum sentence of life in prison.

Burch, a friend of the child?s mother, had been baby-sitting him for weeks in her home. She is accused of injuring the toddler May 22. He died a day later.

Then, the indictment alleges, she stuffed the child?s body into a garbage bag, took it to her cousin?s Spring Grove Village home May 25 and reported the child missing in Covington?s City Heights public housing neighborhood.

That?s where a large search for the child was held by scores of city workers and volunteers in high temperatures.

She initially told police she gave the child ibuprofen and he fell down steps. When she tried to wake him the next morning, she said, he was dead. After suspicious police pressed her, she led them to the relative?s Spring Grove Village closet where the body was found.

The Coroner ruled the child died from a head injury.

Previously, Burch was indicted in the case for gross abuse of a corpse and tampering with evidence. Prosecutor Joe Deters indicated immediately after Burch?s early June indictment that was to hold her while coroner?s testing was completed. He also said at that time Burch was the only suspect in the child?s death.
